Legal matters
1.1 These General Terms and Conditions (GTC) apply to all business relationships between Immo-Portfolio GmbH Switzerland (hereinafter 'Immo-Portfolio') and its clients. The GTC apply irrespective of the type of service provided, be it the sale, purchase, rental or management of real estate.
1.2 Deviating agreements must be made in writing and require the express consent of Immo-Portfolio.
2.1 Immo-Portfolio provides brokerage services in the areas of buying, selling and renting real estate. The services include, among other things, the mediation of prospective buyers and tenants, the preparation of exposés, advising customers and conducting viewings.
2.2 Immo-Portfolio always acts in the interests of the client and endeavors to provide the best possible brokerage and advice.
3.1 A commission is payable for the successful brokerage of a property, the amount of which is agreed individually in advance and may depend on the value of the property.
3.2 In addition to the commission, further costs may be incurred for additional services, e.g. for advertising or marketing measures. These are also agreed in advance.
4.1 The client is obliged to provide Immo-Portfolio with all information and documents relevant to the brokerage and to provide truthful information.
4.2 The Client undertakes to inform Immo-Portfolio immediately of the successful conclusion of a contract, should this have come about without the direct involvement of Immo-Portfolio.
5.1 Immo-Portfolio is only liable for damages caused by gross negligence or intent. Liability for slight negligence is excluded.
5.2 Immo-Portfolio assumes no liability for the accuracy and completeness of the information provided on real estate, as this is based on information provided by third parties.
6.1 Immo-Portfolio undertakes to treat the client's personal data confidentially and to use it only for the purpose of providing the service.
6.2 Data processing is carried out in accordance with the applicable data protection regulations in Switzerland.
7.1 Amendments or additions to these GTC must be made in writing.
7.2 Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected.
7.3 Swiss law applies. The place of jurisdiction is the registered office of Immo-Portfolio GmbH Switzerland.
